1.   INTRODUCTION
This privacy statement gives you the details of how I collect and process your personal data. By providing me with your data, you confirm that you are over 13 years of age.

I, Mary Duggan, am the data controller and am responsible for your personal data.

If you are not happy with any aspect of how I collect and use your data, you have the right to complain to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). I would be grateful if you could contact me first if you do have a complaint so that I can try to resolve it for you.

It is very important that the information I hold about you is accurate and up to date. Please let me know if at any time your personal information changes by emailing me at mary@cockleshellcreative.com

2.  THE DATA I HOLD
The only data that I hold about you for the purposes of the Cockleshell Creative Coaching mailing list is your first name and your email address.

If you buy a package of coaching, or an online programme, or a workshop place or other product or service from me I will also record your full name and your postal address if I need this to mail a physical product to you.

Your mailing list data is stored on the MailChimp secure servers and is password protected. Purchase-related data is stored on the PayPal secure servers and is password protected.
I may also process Aggregated Data via Google Analytics but this data does not reveal your identity and as such in itself is not personal data. An example of this is where I use Google Analytics to understand the age-band and geographical locations of people who visit my website.

I don’t collect any Sensitive Data about you.

3.  HOW I COLLECT AND USE YOUR PERSONAL DATA
You provide me with data by filling in the subscription form on my website or by communicating with me by email. I use your data to send you my weekly newsletter and occasionally send you information about programmes, packages and workshops that I’m offering. If you buy a programme or package from me then I use your data to perform the contract between us, for example by sending you programme content.

You have the right to withdraw consent to marketing at any time by emailing me at mary@cockleshellcreative.com or by clicking on Unsubscribe at the bottom of any email I send you.

These are the ways that I might use your personal data.

To register you as a new subscriber – I use your identity data so that I can provide you with my newsletter, as agreed between us
To register you as a new client – I use your identity and contact data to enable performance of my contract with you
To process and deliver the service or product you have purchased – I use your identity, contact and transaction data to perform my contract with you and where necessary to recover debts owing
To manage my relationship with you, which will include
Notifying you about changes to my terms of privacy policy
Asking you to take part in a survey
Delivering relevant content to you, including newsletters and marketing information about my services and products
Analysing your response to content delivered to you (how often you open emails from me!)

You will receive marketing communications from me if you have:
requested information from me or purchased products or services from me
if you provided me with your details to receive my newsletter and information about my services and products.
I do not share your data with third parties for marketing purposes.

Where you opt out of receiving my marketing communications, this will not apply to personal data provided to me because of a product/service purchase or other transactions.

I will only use your personal data for the purposes for which I collected it. If I need to use your personal data for a purpose unrelated to the purpose for which I collected the data, I will notify you and I will explain the legal ground of processing.
I may process your personal data without your knowledge or consent where this is required or permitted by law.

4.  DISCLOSURES OF YOUR PERSONAL DATA
I may have to share your personal data with the parties set out below:
Service providers who provide IT and system administration services (currently MailChimp for email management, Calendly for appointment generation, EventBrite for workshop registration and Zoom for online meetings).
Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.
HM Revenue & Customs, regulators and other authorities based in the United Kingdom and other relevant jurisdictions who require reporting of processing activities in certain circumstances.

5.  DATA SECURITY
I have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. I have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where I am legally required to do so.

6.  DATA RETENTION
I will only retain your personal data for as long as necessary to fulfil the purposes I collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal data, I consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which I process your personal data and whether I can achieve those purposes through other means, and the applicable legal requirements.
By law I must keep basic information about my clients for six years after they cease being clients for tax purposes.

7.  YOUR LEGAL RIGHTS
Under certain circumstances, you have rights under data protection laws in relation to your personal data. These include the right to:
Request access to your personal data.
Request correction of your personal data.
Request erasure of your personal data.
Object to processing of your personal data.
Request restriction of processing your personal data.
Request transfer of your personal data.
Withdraw consent.

I do not control these third-party websites and am not responsible for their privacy statements. When you leave my website, I encourage you to read the privacy notice of every website you visit.
